We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information.
Payment information is processed through Stripe, a PCI DSS-compliant payment processor. We do not store full credit card numbers on our servers.
8. INFORMATION FROM MINORS
We do not knowingly solicit data from or market to children under 18 years of age. By using the Services, you represent that you are at least 18 years old or that you are the parent or guardian of such a minor and consent to such minor dependent's use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records.

1UP REVIEWS LLC is a company organized under the laws of the State of Indiana. Indiana residents may have specific privacy rights under Indiana law. We are committed to honoring applicable privacy rights for Indiana residents and residents of other U.S. states that have enacted consumer privacy legislation.
Indiana residents may have the right to:

●Opt out of the sale of personal data (we do not sell personal data)
Mobile opt-in data, including phone numbers collected for SMS marketing or review request text message campaigns, will not be sold, rented, or shared with third parties for their own marketing purposes.
Opt-in data is used solely to send the communications for which the individual provided consent (e.g., review request SMS messages sent by us on behalf of our business clients).
All SMS campaigns will include opt-out instructions. Recipients may reply STOP at any time to unsubscribe from text message communications. Message and data rates may apply.
12. CLIENT RESPONSIBILITY FOR CUSTOMER DATA
As a client of 1UP REVIEWS LLC, you act as the responsible party (data controller) with respect to the personal data of your customers that you submit to our platform. We act as a service provider (data processor) processing that data on your behalf according to your instructions.
You represent and warrant that:
●You have obtained all legally required consents from your customers before submitting their contact information to our platform;
●Your collection and provision of customer data to us complies with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and all other applicable federal and state laws;
●You will promptly notify us of any customer opt-out requests so we can suppress future communications to that individual;
●The customer data you submit is accurate and current.
1UP REVIEWS LLC is not responsible for any legal liability arising from your failure to obtain proper consents or comply with applicable law regarding the customer data you provide to us.
13. DO NOT TRACK
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.
